1. Agreement to Terms
By accessing or using HeatFries ("the Platform," "we," "us," "our") at heatfries.com, including the AI Bot Builder, bot marketplace, and any related services, you ("you," "the User") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will indicate changes with an updated "Last updated" date.
2. Eligibility
You must meet the following requirements to use HeatFries:
- Age: You must be at least 18 years old (or the legal age to trade in your jurisdiction, whichever is higher).
- Legal compliance: You are responsible for ensuring that your use of the Platform and any bots you deploy comply with all laws and regulations applicable in your country or jurisdiction.
- Trading restrictions: Binary options, synthetic indices, and CFD trading are restricted or prohibited in certain jurisdictions including but not limited to: the European Union (ESMA regulations), the United States, Australia, Canada, Israel, and others. It is your sole responsibility to verify that trading these instruments is legal where you reside before using any bots from this Platform.
HeatFries does not verify your jurisdiction or eligibility. By using the Platform, you represent and warrant that you are legally permitted to access trading services in your location.
3. Description of Services
HeatFries provides:
- Pre-built trading bots: Downloadable XML files designed for use with Deriv.com's DBot platform. These include both free and premium (paid) bots.
- AI Bot Builder: A tool that uses artificial intelligence to generate custom DBot XML trading scripts based on user-specified parameters (market, trade type, stake, strategy, etc.).
The Platform is a tool provider. We provide software tools that execute trading strategies defined by the user. We do not:
- Provide financial advice, investment recommendations, or portfolio management
- Guarantee any trading outcomes, profits, or returns
- Operate as a broker, dealer, or financial intermediary
- Execute trades on your behalf or hold your funds
- Have access to or control over your Deriv.com account
4. Trading Risk Disclosure
THIS IS THE MOST IMPORTANT SECTION. PLEASE READ IT CAREFULLY.
Trading binary options, synthetic indices, forex, and cryptocurrency involves substantial risk of loss and is not suitable for all investors. You should only trade with capital you can afford to lose entirely.
- No profit guarantee: No bot, strategy, algorithm, or tool provided on this Platform guarantees profits or positive returns. All trading outcomes are uncertain.
- Past performance: Any performance metrics, statistics, backtest results, or theoretical projections shown on this Platform are not indicative of future results. They are based on mathematical models and historical data which may not reflect real market conditions.
- Market risk: Markets are volatile and unpredictable. Automated strategies can experience losses due to sudden market movements, slippage, connectivity issues, or other factors outside the bot's logic.
- You decide: You are solely responsible for choosing which bot to use, configuring its parameters (stake, take profit, stop loss), and deciding when to start or stop it. The final trading decision is always yours.
- AI-generated bots: Bots created by the AI Builder are generated algorithmically. While we validate their XML structure, we cannot guarantee that the trading logic will perform profitably. You must review and test any bot on a demo account before using real funds.
By using this Platform, you acknowledge that you understand these risks and accept full responsibility for any financial losses.
5. Not Financial Advice
Nothing on this Platform constitutes financial advice, investment advice, trading advice, or any other sort of professional advice. The content, bots, strategies, and tools provided are for informational and educational purposes only.
You should consult a qualified financial advisor before making any investment decisions. HeatFries is not a registered investment adviser, broker-dealer, or financial planner in any jurisdiction.
6. User Accounts
When you sign in via Google OAuth, we create an account associated with your Google email address. You are responsible for:
- Maintaining the security of your Google account
- All activity that occurs under your HeatFries account
- Notifying us if you suspect unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.
7. Payments and Refunds
- Premium bots and AI Builder credits are purchased via cryptocurrency payments processed through NOWPayments.
- All sales are final. Due to the digital and instantly-delivered nature of our products (downloadable XML files and AI-generated code), we do not offer refunds once a purchase is completed or credits are used.
- Prices are displayed in USD on the website. Cryptocurrency equivalents are calculated at the time of payment.
- We do not store or have access to your wallet addresses or private keys.
We encourage you to test our free bots and demo accounts before purchasing premium products.
8. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or redistribute bots purchased from this Platform
- Use the Platform to generate bots for illegal or unauthorized purposes
- Attempt to exploit, hack, or compromise the Platform's infrastructure
- Resell, sublicense, or commercially redistribute bots or generated XML without written permission
- Use automated scripts to abuse the AI Builder or overwhelm server resources
- Misrepresent yourself as affiliated with HeatFries
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- HeatFries, its owners, operators, and affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform, including but not limited to trading losses, loss of profits, loss of data, or business interruption.
- Our total maximum liability to you for any claim arising from or related to the Platform is limited to the amount you paid us in the 12 months preceding the claim, or $50 USD, whichever is greater.
- The Platform and all bots are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Indemnification
You agree to indemnify and hold harmless HeatFries and its operators from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform or any bot
- Your violation of these Terms
- Your violation of any law or regulation
- Any trading losses or financial damages you incur
11. Third-Party Services
The Platform integrates with third-party services. We are not responsible for their availability, terms, or practices:
- Deriv.com: HeatFries is not affiliated with, endorsed by, or partnered with Deriv.com. Bots are designed to be compatible with Deriv's DBot platform, but we do not guarantee compatibility with future DBot updates. All trademarks belong to their respective owners.
- Google: Authentication is handled via Google Sign-In. Your use of Google services is governed by Google's Terms of Service and Privacy Policy.
- NOWPayments: Payment processing is handled by NOWPayments. Transactions are subject to their terms and policies.
12. Intellectual Property
- All pre-built bot strategies, AI prompts, website design, and code are the intellectual property of HeatFries.
- Bots you purchase or generate: You receive a personal, non-exclusive, non-transferable license to use purchased bots and AI-generated bots for your own trading. You may not resell, redistribute, or commercially exploit them.
- The AI Builder generates XML based on your inputs. While you own your trading strategy idea, the generated XML code is provided under the license described above.
13. Termination
We may suspend or terminate your access to the Platform at any time, without notice, if we reasonably believe you have violated these Terms. Upon termination:
- Your right to use the Platform ceases immediately
- Unused credits are forfeited and are not refundable
- Sections on liability, indemnification, and intellectual property survive termination
14. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where HeatFries operates. Any disputes will be resolved through good-faith negotiation first. If negotiation fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
